  • Whether a parent has a history of drug abuse, alcoholism, or domestic violence
  • Each parent’s ability to provide a stable environment for the child
  • Each parent’s ability to care for the child
  • Keeping siblings together
  • Where the child currently resides
  • Which parent is more likely to allow the other parent visitation time

Visitation

The courts want both parents to be fully involved the child’s life.  Therefore, in cases where one parent has sole physical custody, the courts will likely grant visitation rights to the other parent.   The visitation schedule—to be decided by the parents or by the courts—will outline what days and times the non-custodial parent has the right to spend time with his or her children.
