Florida Divorce Requirements

In order to be granted a divorce in Florida, one of the spouses must have been a Florida resident for at least six months.  Aside from this residency requirement, there are no other legal requirements a couple must meet.  Florida is a “no fault” state, so as long as one spouse says the marriage is “irrevocably broken,” the judge will grant a divorce.  However, if the other spouse doesn’t agree the marriage is broken, the judge may order the couple to attend marriage counseling before agreeing to a divorce.

Divorce can also be granted if one of the spouses becomes mentally incapacitated for more than three years.
